Terms of Service
Due to the customized nature of our products, all sales are final. For pickup orders, a 50% deposit payment is due upfront upon receiving the invoice. The balance of the total is due upon pickup. For shipped orders, a 100% payment is due upon receiving the invoice.
Level 1 Custom Gear will not be held responsible for any portion of an order where the client supplies the garments. This includes the garment and the print. If we do not supply the garment we will not warranty it.
Level 1 Custom Gear is not responsible for items that are out of stock. While we check items we know to have potential stock issues, all garments are ordered after your order is placed, and we cannot guarantee their availability. If items are out of stock, we will provide you with possible alternatives and get it approved by you before proceeding with production.
There is no way to effectively and efficiently measure a distance from the collar on each shirt as each garment is loaded onto the press by hand. There is a 1" margin of error in each direction for print placement. Any print that is off by 1" or less in either direction will not be considered a misprint and Level 1 Custom Gear will not reprint or refund these shirts.
Cancellations made after an order has been placed will be subject to a 20% restocking fee plus any additional fees required to cover services already rendered. No cancellations will be accepted once production or any manipulation of the garments (tag removal, printed tags, printing, hem tagging, etc.) has begun.
Level 1 Custom Gear is not responsible for manufacturer defects such as colour inconsistencies, stitching errors, mislabeled garments, loose/inconsistent stitching, and/or garment defects such as holes in garments, ripped seams, etc. We do our best to inspect the garments as we print them, but we cannot guarantee each garment. We do not manufacture these garments. We check every garment as it comes off of the press, and again when they are being stacked, but is inevitable that some mistakes will make it to the customer on rare occasions.
It is your responsibility as the customer to check over garments as you receive them. We allow an industry standard 72-hour window from the time you receive the goods to notify us of any issues with the order. Level 1 Custom Gear will not be responsible for errors with your order if notified after 72 hours of receiving the goods.
Level 1 Custom Gear will not be responsible for any lost income, customers, accounts, and/or contracts if defective garments are sent out to your final customer. While Level 1 Custom Gear does frequent quality checks on the garments, the final quality assurance check lies in the hands of you, our customer. We go to great lengths to try to ensure that every order that leaves our facility is correct. We are more than happy to correct any mistakes that are on our behalf with financial replacement. We cannot reprint jobs unless our minimum order quantity of 24 pieces is met again. For example, if a single garment has a defect and the job has been completed, we cannot replace it with a single customized garment, but we will refund you for the cost of the garment and print. This only applies if the garments were provided by us. All claims must be submitted within 72 hours of the date of delivery or pickup.
CANCELLATIONS, CHANGES & RETURNS
- Accepted only with prior written approval from Level 1 Custom Gear
- No cancellations will be accepted if order is in process.
- Any costs incurred by Seller prior to acceptance of cancellation will be invoiced.
- Changes to orders prior to production and after the mockup has been approved will usually require an extra cost.
PRODUCT & COLOURS
Level 1 Custom Gear cannot guarantee exact shade, colour, size, texture, consistency in quality or construction of finished goods as they vary from lot to lot. Exact duplication of ink colours including PMS (Pantone Matching System) colours is not always possible. Level 1 Custom Gear will always attempt to match the colours as closely as possible.
Customer assumes complete responsibility for artwork and warrants that they have the right to use the marks, symbols, or designs depicted in the artwork. Level 1 Custom Gear relies solely on the customer’s representation that they are authorized to utilize any copy or marks and Customer holds Level 1 Custom Gear harmless and will indemnify Level 1 Custom Gear for any and all claims resulting from printing, embroidery or other embellishments performed for customer by Level 1 Custom Gear.
Title to the goods shall pass to Customer upon delivery to customer or common freight carrier at the shipping point. Level 1 Custom Gear is not responsible for delays, lost goods or damages caused by the freight carrier but will assist in tracking shipments. Shipping dates are estimated and not guaranteed. If you have a hard deadline or in-hands date, please verify this at the beginning of the order process with your sales representative.
In the event Level 1 Custom Gear shall be unable or fail at any time to make or supply the goods ordered due to any condition, contingency, delay, failure or cause beyond the control of Level 1 Custom Gear and whether or not any such contingency is presently occurring, Level 1 Custom Gear shall not be liable to buyer for failure to supply during the period and to the extent of such disability including special or consequential damages (including profits or profits lost).
LIMITATION OF LIABILITY
In no event shall Level 1 Custom Gear be liable to Customer for any amount greater than the amount paid to Level 1 Custom Gear to provide goods or services.
